Welcome to India Gate “Grains of Hope Season 3”. This platform lets you create a limited-edition, hyper-personalised film (“AI Video”) generated using Artificial Intelligence (“AI”), featuring you. For every eligible share of the Campaign generated through the Platform, the Company will contribute towards providing one nutritious meal to underprivileged children in India through its charitable fulfilment partner, in the manner described in Part N below.

By using our website/microsite https://indiagategrainsofhope.com/, you (“Participant”, “you”, or “your”) unconditionally agree to comply with these Terms and Conditions (“Terms”). Because this Campaign (the “Grains of Hope Season 3”) involves processing personal data under the Digital Personal Data Protection Act, 2023 (“DPDP Act”) and the Digital Personal Data Protection Rules, 2025 (the “Rules”), please review these Terms thoroughly before proceeding.

A. Details of the Campaign

  1. The Campaign: Engage adult users to create an AI-generated, hyper-personalised Video featuring the Participant, using a selfie uploaded by the Participant. The Video is delivered via WhatsApp. Every eligible share generated through the Platform contributes towards, and is a step forward in, providing a nutritious meal to underprivileged children in India, as set out in Part N.
  2. Campaign Period: Commences on 12th August, 2026 and continues until 30th August, 2026. KRBL Limited (India Gate) (the “Company”) reserves the right to shorten, extend, or terminate this period at its sole discretion without prior notice.
  3. Data Fiduciary: KRBL Limited (India Gate). 5190, Lahori Gate, Delhi – 110006, India.
  4. Data Processor: HiVoco Content-Tech Studios (Audio First Commerce Pvt. Ltd.), acting strictly on behalf of and under instructions from the Company.

B. Participation Guidelines

To participate, you must strictly follow these operational steps:

  1. Visit the official microsite: https://indiagategrainsofhope.com/
  2. Pass the eligibility gate by explicitly confirming you are 18 years of age or older.
  3. Upload/capture a clear selfie of yourself.
  4. Input your first name, your gender, and your valid WhatsApp number.
  5. Review and execute the on-screen consents. Please see Part E of these Terms.
  6. Complete One-Time Password (OTP) verification via WhatsApp.
  7. Upon successful validation, receive your personalised Video on your verified WhatsApp number within a few minutes.
  8. Tap the “Share” button on the Platform to share the campaign film and the microsite link. Each such share is counted by the Platform’s share function and drives the meal contribution described in Part N.
  9. Optionally, and entirely at your own choice, you may also post the personalised Video you receive on WhatsApp to your own social media (for example, Instagram) using #Freedomfromhunger and tagging the Company. This is voluntary and is not required to participate or to generate a counted share.

C. Eligibility

  1. Strict Age Limit: Participation is restricted strictly to individuals who are 18 years of age or older. Persons below 18 years of age are not permitted to participate or to submit any data on the Platform.
  2. No Child Data Collected: The Campaign does not collect any personal data of any child. No child’s photograph, name, or other attribute is uploaded, requested, or processed. The children and characters appearing in the Video are wholly AI-generated and fictional, as further described in Part L.
  3. Verification: The Company shall verify eligibility through an explicit, affirmative digital declaration of age and mandatory WhatsApp OTP verification.
  4. Right to Reject/Erase: If the Company has reason to suspect a breach of these eligibility conditions, or if OTP/identity verification fails, the Company reserves the right to immediately terminate the session, decline participation, and permanently erase any data collected without liability.

D. Participant Conduct, Responsibilities & Absolute Indemnity

  1. Accuracy of Data: You must provide accurate, current, and complete details. The Company is not responsible for delivery failures resulting from incorrect WhatsApp numbers or data inputs.
  2. Your Own Likeness: You warrant that the selfie you upload is of yourself, that you are the person depicted, and that you have full legal right to upload and use it. You must not upload any image of any other person, or any image that infringes any third-party copyright, trademark, privacy, or publicity rights.
  3. Prohibited Content: You are strictly prohibited from uploading any obscene, defamatory, profane, sexually explicit, politically sensitive, or otherwise unlawful/objectionable content.
  4. Use of personalised Video: Participants must ensure that the Video is forwarded only to willing recipients and is not used to harass, threaten or cause distress to any person who may be unwilling to receive it.
  5. Disclaimer on Filtering: The Participant is solely and fully responsible for every image and all content they upload. Any content-screening, filtering or moderation employed by the Company is a good-faith, best-efforts measure and not a guarantee: if any obscene, profane, sexually explicit, offensive or otherwise objectionable image or content is not detected by, or passes through, the checkpoints employed by the Company, the Participant remains solely responsible and liable for it and the Company shall not be liable in any manner. The Company may, at its sole discretion, remove, refuse to process or report such content, and the Participant indemnifies the Company against any resulting claim, loss or liability.

E. On-Screen Consent Framework & Right to Withdraw

In line with the DPDP Act and Rules, any consent taken herein is free, specific, informed, unconditional, unambiguous and given by a clear affirmative action. All checkboxes are unticked by default.

  1. Mandatory Consents: Essential for the generation and delivery of the Video. Refusal prevents participation.
  2. Withdrawal: You may withdraw consent at any time as easily as it was given (e.g., by replying ‘STOP’ on WhatsApp). Withdrawal will not affect processing executed prior to the withdrawal. Upon withdrawal, the Company will cease delivery and erase related data, subject to lawful retention requirements.

F. Itemized Categories of Personal Data Collected

To achieve the specified purposes, the Company limits collection to the following items:

  1. Participant identity & contact data - your first name and WhatsApp mobile number.
  2. Gender - collected solely to personalise how the Video addresses and depicts you.
  3. Image data - the selfie you capture or upload of yourself.
  4. Verification data - OTP and verification status.
  5. Technical & usage data - device, browser, IP address, cookies and interaction logs, including your share count.
  6. No third-party or child data: The Company does not collect any data of any child or of any other person. Only your own personal data, as listed above, is processed.

G. Purposes, Data Processors, and Cross-Border Transfers

  1. Specified Purposes: Core processing is limited to verification, creation, and delivery of the Video, and tallying eligible shares for the meal contribution in Part N.
  2. Data Processors & Safeguards: The Company utilizes HiVoco Content-Tech Studios under strict written contracts pursuant to the DPDP Act.
  3. No AI Training on User Assets: The Company explicitly mandates that your selfie shall not be used to train, fine-tune, or improve any public or proprietary AI/LLM models managed by the data processor.
  4. Cross-Border Transfers: Personal data is processed and stored on cloud infrastructure located in Mumbai, India. The Company confirms that no personal data is transferred to, or processed in, any country restricted under a notification issued by the Central Government pursuant to Section 16 of the DPDP Act, 2023. The Data Processor shall notify the Company immediately of any change in hosting geography during the Campaign Period.

H. Data Retention & Mandatory Erasure

  1. Transient Data Assets: Your uploaded selfie used for Video generation will be permanently deleted from the active processing servers promptly after delivery of the Video, and in no event later than 1 day from upload.
  2. Campaign Core Data: Personal data collected for validation, delivery of the Video or share-tallying will be retained only until the expiration of the Campaign or 1 day post-closure, whichever is later.
  3. Statutory Logs: Pursuant to the Rules, systemic transaction and processing logs will be retained securely for a minimum period of 1 day where required under the DPDP Act and underlying Rules.

I. Security Safeguards & Breach Management

  1. Security Infrastructure: The Company shall employ robust technical and organizational security measures, including end-to-end encryption, data masking, strict access controls, and virtual tokenization to mitigate personal data breaches.
  2. Your uploaded selfie is subject to heightened protection - access is restricted to the minimum personnel and systems required to generate the Video, and it is erased as set out in Part H.
  3. Breach Notification: In the unfortunate event of a personal data breach, the Company will notify the relevant authorities and you as per applicable laws.

J. Rights of the Data Principal

As a data principal, you possess the right to Access, Correction, Completion, Erasure, and Nomination under the DPDP Act. You may execute these rights by reaching out to our Grievance Officer.

K. Grievance Redressal Mechanism

The Grievance Officer shall acknowledge grievances within [insert, e.g. 7 days] and resolve them within a period not exceeding 90 days, or such other timeline as may be prescribed under the DPDP Act and Rules. In accordance with regulatory protocols, you must exhaust the Company’s internal grievance mechanism before escalating any dispute to the relevant judicial authorities or to the Data Protection Board of India (DPBI), as and when constituted.

L. Nature of AI-Generated Content & Coincidental Resemblance

  1. Wholly AI-Generated Output: Other than your own uploaded selfie, the entire Video - including all scenes, backgrounds, characters, children, school and school-assembly settings, uniforms, and any other persons or elements depicted - is wholly generated by AI and is fictional in nature.
  2. No Real Individuals Depicted: No real, identifiable child or other individual is depicted, reproduced, or portrayed in the AI-generated portions of the Video. The Company does not use, upload, or process any photograph or personal data of any child or third party in creating the Video.
  3. Coincidental Resemblance: Any resemblance, similarity or commonality between any AI-generated character, child, face, school, uniform, dress, institution, logo, name or event appearing in the Video and any real person (living or deceased), child, school, institution or event is purely coincidental and entirely unintentional. Any such resemblance does not imply any association, endorsement, identity or connection whatsoever.
  4. No Inference of Association: The appearance of school, children, school-assembly or similar settings, and any incidental clarity of uniforms or dresses, is a generic creative depiction only and must not be construed as depicting, referencing or being affiliated with any actual school, institution or child.
  5. Reporting Concerns: If you believe the Video contains content that resembles a real, identifiable individual or institution, please contact the Grievance Officer and the Company will review and, where appropriate, remove or amend the content.

M. Intellectual Property & Limited Licensing

  1. Company Ownership: The Company will remain the sole and exclusive owner of all right, title, and interest (including any intellectual property rights or other rights) in and to all Company brands, logos, creative and artistic works, designs, data, information, and materials owned or licensed by the Company (collectively, the “Company Materials”), including the AI-generated elements of the Video. Nothing in these Terms shall, whether expressly or by implication, be deemed to transfer any ownership interest in any Company Materials to you. All rights not expressly granted by the Company under these Terms are reserved by the Company.
  2. Limited User License: Participants are granted a non-exclusive, non-transferable, non-sublicensable, revocable license to use, download, and share the final Video for strictly personal, non-commercial purposes. Any commercial exploitation, modification, or sale of the Video is strictly prohibited.
  3. Your Selfie: You retain ownership of your uploaded selfie and grant the Company a limited, revocable license to use it solely to generate and deliver your personalised Video.
  4. User-Initiated Social Sharing: If you choose to share your generated Video publicly on platforms such as Instagram and tag the Company’s official handle, you grant the Company a non-exclusive, worldwide, royalty-free license to reshare that specific post. This remains active until you delete the post or remove the tag.

N. Share Mechanic & Meal Contribution

  1. How it works: Each eligible, verified share of the campaign film and the microsite link, generated through the Platform’s “Share” function, is counted. Each counted share represents one step forward towards, and a contribution by the Company towards, providing one nutritious meal to underprivileged children in India.
  2. Fulfilment: All meal contributions are made in India and are fulfilled by the Company through its charitable/CSR fulfilment partner Akshaypatra. The contribution is a charitable initiative of the Company and is not a payment, prize, or benefit to any Participant.
  3. No Purchase / No Consideration: Participation and sharing are free of charge and require no financial consideration. No cash or other equivalent is payable to any Participant in lieu of the contribution.
  4. Contribution Basis: The total number of meals contributed corresponds to the number of eligible counted shares generated during the Campaign - for example, 90,000 or 1,00,000 eligible counted shares would correspond to that many meals. No maximum limit is set as of the launch of this Campaign. The Company may, at its reasonable discretion, revise the mechanic or count or introduce a limit, subject to the arrangements with, and capacity of, the fulfilment partner.
  5. Anti-Fraud Clause: The use of click-bots, fake accounts, script automation, or artificially inflated or incentivised shares is strictly prohibited. Such activity will be excluded from the share count and may result in immediate disqualification and erasure of data.
  6. No Guarantee to Any Individual Child: The contribution is directed to the fulfilment partner’s beneficiary programmes generally. No Participant acquires any right to direct the contribution to any specific child or beneficiary.

O. Third-Party Services Disclaimer

The Platform integrates third-party tools, cloud environments, and generative AI models (LLMs). By participating, you acknowledge that these tools are subject to external acceptable-use policies. The Company disclaims all liability for intermittent technical glitches, network latencies, or processing errors caused by external provider systems.

P. Governing Law, Jurisdiction and Dispute Resolution

  1. These Terms are governed by and construed in accordance with the laws of India. Any dispute, controversy or claim arising out of, relating to or having any connection with these Terms or the Campaign, shall be referred in writing and finally resolved in accordance with the Arbitration and Conciliation Act, 1996 (“Arbitration Act”) as amended from time to time. The seat of the arbitration shall be in New Delhi, India. The Tribunal shall consist of a sole arbitrator, mutually appointed by the parties. If the parties fail to appoint an arbitrator within 45 (forty-five) business days from the date of receipt of the request for appointment of arbitrator, the arbitrator shall be appointed as per the provisions of the Arbitration Act. The cost of the proceedings shall be equally borne by the Parties, unless otherwise determined by the sole arbitrator. The language of the arbitration shall be English. The award of such arbitrator shall be final and binding on the Parties and may be enforced by any court of competent jurisdiction.
  2. Subject to the provisions of clause P(1) above, the Parties irrevocably submit to the exclusive jurisdiction and venue of New Delhi, India, for any such suit, action or proceeding.

By proceeding, you explicitly agree to the Terms of this Campaign.

Mandatory Declaration:

“I confirm that I am 18 years of age or older and that the selfie I upload is of myself, and I have full legal right to upload and use it.”

Data Approvals:

  1. Mandatory - I consent to the Company processing my name, gender and selfie to generate my personalised AI Video.
  2. Mandatory - I consent to the Company using my WhatsApp number to conduct OTP verification, deliver the Video and send essential Campaign details.
